Todd, Evans & Figel, P.L.L.C., was formed in 1993 by three partners who left
their large law firms to start a small firm focused on trial and appellate
litigation. The firm has grown rapidly. Our current roster of more than 50
talented attorneys includes former Assistant United
States Attorneys, Assistants to the Solicitor General, and attorneys who have held
senior positions in the White House and the Department of Justice, including a
former Assistant Attorney General and Counselor to the Attorney General. Almost
all of our lawyers have served as law clerks to federal circuit or district judges,
and nearly one-third have clerked for Supreme Court justices. The firm’s areas of practice include general commercial litigation, Supreme Court and appellate litigation, antitrust, class actions, governmental investigations, intellectual property, products liability, securities fraud, telecommunications, and white collar criminal defense. Our lawyers have been lead counsel in more than 100 federal and state trials and private arbitrations. We successfully litigate on behalf of both plaintiffs and defendants, and we regularly take cases to verdict at trial. The firm’s attorneys have written about and taught trial and appellate advocacy in programs at the Federal Judicial Center and the National Institute of Trial Advocacy. The firm’s appellate lawyers have achieved exceptional results for our clients. Our lawyers have won significant cases in the United States Supreme Court in each of the past seven Terms. During that period, our lawyers have argued 25 merits cases in the Supreme Court, including such important antitrust cases as Bell Atlantic Corp. v. Twombly and Pacific Bell Telephone Co. v. linkLine Communications, Inc., and the landmark preemption cases of Wyeth v. Levine and Altria Group, Inc. v. Good. During the Supreme Court’s October 2009 and 2010 Terms, the firm’s lawyers litigated 14 merits cases and successfully represented the State of Tennessee in Mississippi v. City of Memphis, et al., No. 139, Orig., at the pleadings stage. By the conclusion of the Supreme Court's October 2011 Term, the firm's lawyers will have argued four additional cases. Our attorneys also have litigated extensively in the federal appeals courts, and they have written articles and treatises on Supreme Court and appellate advocacy. Our lawyers have broad experience representing businesses and individuals in complex administrative and criminal enforcement proceedings. We conduct internal investigations on behalf of multinational clients seeking to manage and resolve liability under the Foreign Corrupt Practices Act, the securities laws, and the antitrust laws, among other criminal and regulatory regimes. We appear frequently before the Department of Justice and the Securities and Exchange Commission, as well as before federal and state regulatory agencies, in connection with these matters. The firm also has a substantial patent practice, and we represent both patent holders and accused infringers in cases involving a broad spectrum of technologies, including, in recent years, semiconductors, multifunction printers, optical disc drives, medical ultrasound equipment, e commerce services, telecommunications equipment and services, and pharmaceuticals. Our firm regularly represents major telecommunications providers in judicial and administrative proceedings at the federal and state levels.
